WHATS IN THE BILL
Up Date 5-10-2010: The Importance of the Birthright Citizenship Act of 2009!
A new bill introduced on May 26, 2009, deals with the increasing problem of "anchor babies" and illegal immigration. I will be following this bill to its conclusion. In fact, everyone should be concerned with the bill. If passed, it will correct an egregious blunder in our immigration laws. Do we need a bill like this—definitely! The bill removes a key incentive for those who defiantly enter our country illegally each day. The innocent pawn in this illegal scheme is the “anchor baby,” which, has a far-reaching and devastating impact on the financial and economical security of the United States.
HR 1868 represents “The Birthright Citizenship Act of 2009.” In essence, it will abolish birthright citizenship for children (anchor babies) born in the United States to illegal aliens. It will establish that the 14th Amendment award citizenship only if one of the parents is---a U S citizen or national---a lawful permanent resident alien in the United States---or an alien on active duty in the U S Armed Forces.
The present U S guidelines provide an incentive, which entices the illegal entry of women into the United States. Once their “anchor baby” is born within U S borders, he or she becomes a U S citizen. The “anchor baby,” also becomes eligible for all assistance programs’ including Social Security and it does not stop there. Not only do they remain here, they bring additional relatives in causing an even greater impact on U S taxpayers. This illegal behavior has resulted in approximately 300,000 additional citizens per year.
In my opinion, the bill still allows too much leeway for citizenship abuse. Unless one or both parents are legal citizens of the United States, then a child born here should not be granted citizenship.

Delores, the problem in part is due to the large number of anchor babies being born. We had this illegal issue 26 years ago, and our country granted them Amnesty. That perpetuated the very problem we have today. Last, but not least, our government deliberately refuses to do the right thing and enforce our immigration laws.
Now look at the serious problems we have with our southern borders…Today, the drug cartel and their senseless violence spilled across the Mexico border into El Paso, TX.
Nancy, there are so many illegal people here today, it is a big problem. I have heard that certain agricultural aggreements and practices have greatly reduced the availability of farm work and jobs in Mexico. There needs to be economic improvements in Mexico so that the people who live there have more opportunities. Then of course, we have the problem of the people here who hire illegals so that they can save money on labor costs and benefits.
Now they are looking at the inmates of Texas prisons. It is thought that as many as 40% of Texas prison inmates are illegals and it would behoove the government to deport these prisoners, that it would be more cost effective than keeping them in prison. However, I could see where the released and deported prisoners could just turn around and come back, thus we'd have more criminals on the loose.
The illegal immigration problem is very complicated.
Delores, your insights on immigration are valid. However, until the people of Mexico demand and fight for change, their present life style will continue. Everything we have today is the direct result of the desire and measures our ancestors took for a better life.
Until OUR government executes meaningful penalties against employers, who entice the illegals and illegals who sneak across the border, our problems will continue. Finally yet importantly, it brings us back to why HR 1868 is a pivotal bill.
The fact is, countless numbers of Mexico’s criminal element are deported, and then return to the United States only to be deported again, and again. That proves the enormous security threat to our country…However; our political leaders refuse to enforce “existing immigration laws” because of political agendas. This lack of accountability deserves a pink slip!

It does seem odd, why have laws if they are ignored? I don't mind anyone coming here at all, I just want them to be legal, to pay for the services they receive, just as the rest of us have to do.
Mulberry, thanks for your comment and I agree with you. I don't have an issue with anyone entering this country legally and paying their own way. My second biggest problem is with our government who will not enforce the immigration laws already in place...
A problem is that it is extremely difficult for someone to enter and work legally. I had to go through a lot - and that was already after I had been studying here for over 10 years. There were some really unpleasant things like publishing my salary for everyone at work to see, and much more. And the green card process involved a lot of lawyers, reams of paper work, and many years of waiting, finger-printing, physical exams, etc etc etc.
Not anymore. One thing we've seen a decrease in is the number of illegal immigrants. People go where they think they can better themselves. We don't seem to be that place anymore. That little factoid is more important than a stupid bill like this one. It's racist and dumb. We should take it as a compliment that people want to come here. Immigrants helped us build this nation from nothing. They could also help us recapture our faded glory. Do you really want to send kids back to the hellholes their parents fled from, or break up families. If that's what America has become then I'm ashamed to be one. Shame on you.
Ledefensetech, if you are here legally then you respected our immigration laws. However, breaching a country’s immigration laws is WRONG!
The fact that American citizens "expect" immigrants to COMPLY with our laws is neither “dumb nor racist”! Racism is a scapegoat excuse for those who defiantly continue to break our immigration laws.

Nancy, for your information I'm a citizen. Immigration laws are stupid. The only reason we're still a growing vibrant nation is because of our immigrants. Immigrant laws only became popular in the 1920's which historically was one of the most racist periods in American history. It's very stupid to pass laws that people won't respect. In this case the legislators have gone too far. Let me ask you this. If they passed a law that said all left handed people should go to camps to make them right handed, would you follow such a law? Why or why not?
It's a moot point anyway. Things suck so bad here now, people are trying to get away, not trying to come in. And that's sad.
Hi Nancy, in the strict sense of the word, breaking laws is 'wrong', but then not all laws are 'right' - e.g. slavery, segregation laws, etc.
I think that many immigrants, legal and illegal are just hard working people who are trying to do their best for themselves, their children, and their families. What some in the media try to do in stereotyping them as criminals who try to steal this country's resources, and get a free ride is an unfair and cruel caricature.
Currently, the immigration laws are pretty extreme and it is very difficult to get in and work legally even if you are very highly educated and have many skills. For those who are less educated, but are still willing to put in the work, their chances are pretty much nil. As a result some resort to come in illegally. Not saying it is right or wrong, but there are always two sides to every story. Is a starving man that steals right or wrong? I don't know - it is hard to say.
The solution I think is not to institute more immigration laws and harsher immigration laws but to give hard working people who have skills that employers here want, a better *legal* path to success.
More immigration laws will just lead to more illegal immigrants - not fewer. But if you give people a path or possibility or doing things legally they will grab it with both hands.
shibashake, thanks for your comment on this delicate issue. However, I live on the southern border and see first hands the results of our government’s failure to enforce the immigration laws that presently exist. This “anchor baby bill” I have written about is to correct a problem that encourages illegal border crossings. No other country grants citizenship at birth to foreigners in their country.
I understand what you experienced was difficult in this area because I have a friend that went through the same thing. My issue is not with those who enter legally---and never has been. Research my topic and you will understand how the deliberate abuse of our immigration policies has affected everyone in this country. Especially those living on the southern border of Mexico.
This is not about racism; it is about doing what is right! My family is full of varied nationalities (many of them legal immigrants) and we are a proud group of people. So are thousands of Hispanic families who came here legally years ago. They also feel illegal entry into our country is wrong. In fact, they are some of the largest groups fighting this issue.
Chris Cannon said it best, ““The American people are not anti-immigrant. We are concerned about the lack of coherence in our immigration policy and enforcement.”

Sorry Nancy, but I still see that stance as narrow minded and short term. Even Japan, which can be one of the more zenophobic countries in the world, has been looking at ways to encourage immigration. The main reason being that there aren't enough people to take care of the elderly there. We're going to be faced with a similar problem soon.
One of the biggest problems we have with immigrants these days is that they are not expected to assimilate into this country. That's exacerbating the usual problems immigrants have assimilating into the mainstream of American life. They aren't expected to learn the language, given free welfare, etc. One of the main reasons is by not allowing them to assimilate into the mainstream, that keeps the immigrants weak and isolated.
Now certain groups in this country want it that way. If they can claim to "champion" the "rights" of those immigrants, they have a ready made base that will mindlessly vote for them and help keep them in power. The best thing we could do is fast track these people into this country, help them assimilate and let them do what they do best; start new businesses and keep the economy growing. Immigrants, not established Americans open and succeed at businesses. Those businesses are what renews the economy and keeps it strong. By keeping people out, in the end, we hurt ourselves.
By keeping immigrants weak and isolated, we only hurt them.

Our country is set up to be anti-american. Our immigrantion laws are not enforced do to misappropiation of government funds. Instead of providing services to said illegals The monies should be appropiated to the enforcement of laws. and to gap the obvious holes in the system. These holes allow the immigrants to receive services paid for by our tax dollars. In turn our own natural born citizens who are in need are put through the ringer to get help. I have been seeking help for one year now and all I state I can document as true. I find that everyone in power knows the goings on within there jurisdiction be it government or social networks. Yet, nothing is done no one is doing anything about it, Where does one turn when every place they go it falls on deaf ears. Actions are condoned and the obvious breach of our constitution allowed
Molly, I'm sorry you are going thru a rough time right now. I sympathize with your situation and your comments are indeed true. However, until we vote these career politicians out of office nothing will change…We do not need new immigration laws, we just need our government to enforce the ones we have and we definitely need this “anchor baby” bill passed. It is one of the most abused loopholes for gaining citizenship.

Go to an emergency room in Texas and all you will see are low income people in front of you in line. I am no better than anyone else, but I do work hard, and I am responsible. I have to wait in line for 8 hours to get my sick/hurt 2 year old into the emergency room because there are so many illegals and low income families in there with their kids who do not have emergencies. They just don't have insurance, so the ER is their family doctor. What benefits are there to being a responsible citizen in this country? Just let them all into our country unchecked? Is that the answer? If you hate our country so much, then go somewhere else. No one is stopping you. Why go to the trouble of becoming a citizen if your country of origin is better? I agree that America is not what it used to be, but it is not because of any one political issue. It is because the people have changed. Our nation was founded by people seeking religious freedom. Christian freedom. We have lost our morals. We have lost our way. I'm no better than the rest, but I do know this to be true. Just look at history and see if you can detect a pattern in the rise and fall of nations. God blesses those who worship him, but brings correction to those who are evil. Where did we start, and where are we now? Those who say America was not founded on Christian principals practice self deception. Read about the lives of our founding fathers. George Washington is a good example. Then, look at where we are today. Porn is a bigger industry than Major leauge baseball, the NBA and the NFL combined. We kill babies. It just doesn't get any more fundamentally wrong than that. Direction, not intentions determine your direction. Where are we headed? These are just my observations. I am not on any one side of any issue. I don't think any of us have it all right, but these are some of the things that I know to be true.

The entire reason for all this anchor baby garbage is the clause in the 14th amendment that says 'and is subject to the jurisdiction thereof' This means 'the LEGAL jurisdiction thereof' PERIOD!! The context of the 14th amendment is legal in meaning and nothing else. When an illegal comes here and violates our laws any supposed 'rights the illegal has to any entitlements are 'NULL' meaning unlawful and negates 'birthright citizenship' If you are illegally here, the 14th amendment does not apply because the premise of being here is through illegal means. Only lawful acts apply to the 14th amendment. So any politician that says 'anchor babies' are due to birthright citizenship are purely lying to the American public and should be removed from office for treason to the U.S.A. Our founding fathers were not stupid and this supposed weakness in the 14th amendment is just a ploy the anti illegal traitors are peddling. Wake up America, they are lying to us and destroying our country and making a mockery of our constitution.

I'm tired of the "they break the law so they can have a better life" defense. If it's okay to break the law because it'll allow you to have a better life, should I be allowed to steal a car? I mean, that'll give me a better life, so why shouldn't I be allowed to do that?
Yours is the same frustration many of us feel Robin. Why is it OK to prosecute the “legal” citizen for breaking laws yet protect and reward illegal aliens with amnesty? They have deliberately broken our immigration laws along with stolen and/or fictitious ID fraud; it is complete INJUSTICE!

Would HR 1868 impact those middle class (or higher) Mexican citizen parents who have legal entry into US and legally pay for the entire birth process?
Carlos, If the parents are not legal citizens of the United States then yes, it would impact them. One must understand that individuals from all over the world are abusing the U,S. birthright citizenship rule; legally and illegaly. Many countries have and are repealing birthright citizenship rules/laws because of the abuse.

The question is - how come all of a sudden there are so many illegal aliens? It wasn't such a big problem years ago, but the number has risen dramatically.
